Having decided to set up a business in Tajikistan, at some point, investors usually have to come to Tajikistan in person. This chapter outlines different visa options and explains general procedures for foreign nationals who intend to set up and run a business in Tajikistan.

Authorized state bodies to issue, extending the terms, recovery, and cancellation of visas are:

• Diplomatic and Consular Missions of the Republic of Tajikistan abroad
• Consular Department of the Ministry of Foreign Affairs of the Republic of Tajikistanabroad
• The Representation of the Ministry of Foreign Affairs in the Republic of Tajikistan (consular office at the airports, the Representation of Ministry of Foreign Affairs of the Republic of Tajikistan in the regions and in the free economic zones).
Decisive for the appropriate type of visa are length and purpose of the intended stay in Tajikistan. There are a number of different visa available, mainly depending on the purpose of the person’s stay in Tajikistan.

Diplomaticvisa will be issued:
• Diplomaticvisa will be issued,
• To head of the Governments of foreign States,
• To members of official foreign delegations,
• To diplomatic agents of diplomatic representatives and consular officials of consular establishments.
• To employees of foreign policy departments, foreign diplomatic and consular couriers,
• To employees of representations of international organizations, whom the Republic of Tajikistan admits their diplomatic status,
• To the inspectors who are carrying out inspections in the territory of the Republic of Tajikistan as per signed agreements.
• To members of families of the listed persons, having diplomatic passports.
A Business Official Visa will be issued:
• To members of official foreign delegations,
• To the administrative-technical and attendant employees of diplomatic representatives.
• To consular employees and workers of the attendants of consular establishments of foreign states.
• To employees of international organizations operating in the Republic of Tajikistan.
• To the persons carrying diplomatic mail, in the absence of a diplomatic passport.
• To honorable Consuls of the Republic of Tajikistan abroad.
• To the foreign citizens who are traveling to the Republic of Tajikistan on service affairs, on behalf of the ministries and the departments of foreign states, irrespective of a category of passports shown by them.
• To members of families of above listed persons.
An Investment Visa will be issued:
• To heads of world famous foreign firms and companies going to Tajikistan and also being in the Republic of Tajikistan, who really participate in investment of economy of Tajikistan (investment amount of at least 500.000 US$).
• To representatives of an administrative part of a large foreign firm and companies working in the Tajik market or having concrete plans for the development of business projects in Tajikistan.
• To members of families of above listed persons.
A Business Visa will be issued:
• To foreign citizens who want to visit the Republic of Tajikistan with a concrete business purpose e.g. participation in business negotiations, at meetings, symposiums, forums, conferences, tenders, the conclusion of contracts, creation of joint ventures, studying of Tajik market, participation in auctions, exhibitions and fairs, rendering of advisory and auditor services etc.
A Work Visa will be issued:
• To foreign citizens who want to visit the Republic of Tajikistan for the admission of employment, including international contracts and agreements.
• To members of families of above listed persons.
A Free Economic ZoneVisa will be issued:
• To foreign citizens-investors who want to visit the Republic of Tajikistan for the realization of labour and enterprise activity in the territory of Free Economic Zones.
A Visa for commercial activities will be issued:
• To foreign citizens who are engaged in commercial activities.

— Validity of Visa:

Respective visas can be issued as Single entry Visa, double entry Visa or multiple entry Visas.

// Validity of Visa

The validity period of a visa in Tajikistan depends mainly on the purpose of entry and can be summarized as follows:
• Diplomatic Visa — Depending on timeframe of diplomatic activity in Tajikistan; declared period cannot exceed two years.
• Business Official Visa — For the requested period, extension for one year possible.
• Investment Visa — Valid for the period of 2 years.
• Business Visa — For the requested period; extension for one year possible.
• Work Visa — Initially for three months; extension upon presentation of signed labour contract with inviting organization.
• Free Economic Zone Visa — Valid for the period of 3months.
• Visa for commercial activities — Valid for the period of 3 months.
Application for a Visa extensionmust be initiated 20 days before an initial Visa expires.

— Where to apply for a Visa?:
For most foreign nationals, visas must be obtained in their respective home country, prior to entering the Republic of Tajikistan. The Tajik Embassies or Consulates abroad are responsible for receiving applications and issuing relevant visas.
Foreign visitors from countries without a Tajik Embassy or Consulate department can obtain a Visa upon arrival in the Republic of Tajikistan. To receive a Visa upon arrival, a registered letter from the Tajik Ministry of Foreign Affairs, confirming the applicant’s request for a Visa is required. Visa upon arrival will be issued for 45 days only at the Immigration Office at the International Airport in Dushanbe, located in the arrival lounge.

// Prerequisites to obtain a Visa

Foreign nationals travelling to Tajikistan should submit the following documents to the Tajik Embassy or Consulate in their home country:
1) General requirements. Two visa application forms with signature (use BLOCK LETTERS); Please ensure that the exact entry and exit date is included (This form can be downloaded from Embassy websites, and from the Tajikistan Ministry of Foreign Affairs website at www.mfa.tj).www.mfa.tj )
2) Two passport sized photos (authentic, no hat, no dark spectacles; color, size of 3,5 x 3,4 cm); photos have to be affixed to the application forms.
3) Valid Passport (no pages removed; at least two clear pages for visa); the passport must be valid for at least six months from the date of departure.
4) Photocopy of the first page of passport.
5) A money order or company check payable to the Embassy of Tajikistan. Please take note, that cash or personal checks are not accepted.
6) In case of the application for Visa by mail, a stamped self-addressed-envelope has to be added,For children less than 16 years old, parents should submit a notarized letter stating that children will be accompanied by their parents.
Additional requirements depending on the type of Visa.
• Business official visa — Diplomatic visa A ‘Note Verbale’fromforeign policy Departments, diplomatic representatives and/or Consular Establishments of the foreign States.
• Business official visa — A ‘Note Verbale’fromforeign policy Departments, diplomatic representatives, Consular Establishments of the foreign States and/or the international organizations.
• Investment visa— A letter-petition of the respective companies or the State Committee for Investment and State Property Management of the Republic of Tajikistan.
• Business visa — A letter-petition of representations of the foreign companies, organizations and/or a legal person, irrespective of their form of ownership.
• Work visa — A petition fromthe inviting organization or a citizen of Tajikistan requesting the issuance of a visa, accompanied by thelabour contract.
• Free economic zonevisa— A letter-petition fromthe Administration of free economic zones and the work permit authorizations.
Foreign citizens who are going to stay in Tajikistan for more than three months except for the visa categories; “diplomatic”, “business official” and “investment” require a certificate from the medical institutions to prove that they are not infected with HIV/AIDS.
For those traveling to GBAO or Pamir region, it is required to submit a letter stating that the applicant is requesting a permit to enter the mentioned area. There is additional cost for this permit.
Note on processing time of visas Processing time of visas: 20 working days after submission of completed documents to the authorized state body.
Incomplete application documents or additional inquiries can prolong the processing time up to 15 working days. State Authority bodies are not required to explain the reasons for any rejection of visa applications.

— Note on refund of consular fees
Consular fees determined by the Government of the Republic of Tajikistan differ in various countries.
Consular fees are not subject to reimbursement.
For the following countries, the Republic of Tajikistan has a Visa free regime:
1. Armenia — by all kinds of passports
2. Belarus — by all kinds of passports
3. Georgia — by all kinds of passports
4. Kazakhstan — by all kinds of passports
5. Kyrgyzstan — by all kinds of passports
6. Moldova — by all kinds of passports
7. Russian — by all kinds of passports
8. Azerbayjan — by all kinds of passports up to 3 months
9. Mongolia — by all kinds of passports up to3 months
10. North Korea — on diplomatic and official passports
11. China — on diplomatic and official passports, and also on passports of service purpose (marked “Service”) up to 30 days
12. Hungary — on diplomatic and official passports up to 3 months
13. Ruminia — on diplomatic and official passports up to 3 months
14. India — on diplomatic and official passports up to 30 days
15. Iran — on diplomatic and official passports up to 30 days
16. Tyrkemnistan — on diplomatic and official passports up to 30 days
17. Uzbekistan — on diplomatic passports up to 30 days
18. Ukraine — by all kinds of passports up to 3 months
19. Afghanistan — on diplomatic passports up to 30 days

// Registration requirements upon arrival

Foreign nationals with a valid visa mustregister in the Ministry of Foreign Affairs of the Republic of Tajikistan within72 hours (3 days)of arrival.Failure to do so will result in heavy fines, and may jeopardize future visa extension possibilities. Registration requires the submission of the original passport, a passport photocopy, mailing address (either the name of a hotel or a home stay) and payment of a registration fee.
Registration of foreign Nationals has always to be carried out in the primary place of stay. According to the person’s visa application or the written request of an inviting organization, registration will be undertaken only for the duration of the indicated timeframe in the application form or other relevant documents. Registration of foreign nationals may be arranged by the sponsor or host (in the case of a hotel).
