Information about Arbitration

1. The International Commercial Arbitration Court (ICAC) under the Chamber of Commerce and Industry of the Republic of Tajikistan is an independent, permanent arbitration court. 2. It was established under the CCI, but functions autonomously and is financed by arbitration fees of the parties. 3. The ICAC headquarters are located in Dushanbe, which is convenient for applications from both national and foreign companies. 4. Since August 14, 2012, after Tajikistan joined the New York Convention of 1958, decisions of the Tajik ICAC are subject to recognition and enforcement in more than 170 countries. 5. The court considers investment, commercial and economic disputes, giving the parties the opportunity to choose arbitrators and the language of the proceedings, which makes the process flexible and prompt. 6. Industry events emphasize that ICAC decisions are made faster than in state courts, which increases its attractiveness for investors. 7. In May 2025, a round table was held in Dushanbe with the participation of arbitrators from Kyrgyzstan and Uzbekistan, dedicated to the popularization of the institution of arbitration among businesses and lawyers. 8. It was noted that many foreign companies are not yet aware of the existence of a convenient arbitration platform in Tajikistan, and the Chamber intends to actively inform the market. 9. In 2024, the ICAC at the CCIRT signed a cooperation agreement with the ICAC at the CCIRF, providing for the exchange of arbitrators and joint educational programs within the CIS. 10. The development of arbitration is enshrined in the “Concept for the Development of International Commercial Arbitration under the CCIRT for 2020–2021”, where the priorities include training judges and lawyers in the application of the New York Convention and international arbitration rules.
